BlueBird iT Solutions recommends consulting a qualified Privacy Officer or legal counsel to address any identified gaps. Nothing contained in this tool, its questions, scoring methodology, gap reports, or recommendations constitutes legal advice, regulatory guidance, or a professional opinion of any kind. References to PHIPA sections and related legislation are provided for general context only.

2. Not a Substitute for Professional Counsel

This tool is not a substitute for a qualified Privacy Officer, healthcare lawyer, or regulatory compliance specialist. Healthcare providers subject to PHIPA are strongly encouraged to engage qualified professionals to assess, document, and maintain their privacy compliance program.

3. Self-Reported Results — No Verification

All responses entered into this assessment are self-reported by the user. BlueBird iT Solutions does not independently verify, audit, or validate any responses, representations, or claims made during the assessment. Results reflect only the information you provide; inaccurate or incomplete responses will produce inaccurate results.

4. No Compliance Certification

Completing this assessment, receiving a compliance score, or following any recommendations made in connection with this tool does not constitute, certify, or guarantee compliance with PHIPA, the Freedom of Information and Protection of Privacy Act (FIPPA), or any other applicable federal, provincial, or regulatory requirement. PHIPA compliance is determined solely by your own practices and, where applicable, by the Information and Privacy Commissioner of Ontario (IPC).

5. IPC Investigations Are Independent

The IPC investigates complaints and breaches independently of any third-party tools or assessments. This assessment has no bearing on any IPC investigation, audit, or order. BlueBird iT Solutions has no affiliation with the IPC.

6. Limitation of Liability

To the fullest extent permitted by applicable law, BlueBird iT Solutions, its officers, employees, contractors, and affiliates shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from: (a) your reliance on the results, score, or recommendations produced by this tool; (b) inaccurate or incomplete responses submitted by you; (c) any regulatory finding, IPC order, or penalty resulting from your organization's privacy practices; or (d) any decision made or not made on the basis of this assessment.

7. No Guarantee of Outcomes

BlueBird iT Solutions makes no representation or warranty that implementing any recommendation arising from this assessment will achieve full or partial PHIPA compliance, prevent a privacy breach, or satisfy any regulator. Every healthcare organization's circumstances are unique.

8. Use of Results by BlueBird iT Solutions

By completing this assessment, you acknowledge that BlueBird iT Solutions may use your contact information and high-level assessment results to follow up with information about relevant IT, privacy, and compliance services. Your detailed responses will be handled in accordance with BlueBird's Privacy Policy and will not be sold or disclosed to unaffiliated third parties. You may opt out of follow-up communications at any time.

9. Accuracy of Tool Content

While BlueBird iT Solutions has made reasonable efforts to align this assessment with current PHIPA requirements as of the effective date above, legislation, regulations, and IPC guidance may change. This tool may not reflect the most current legal standards at the time of your use. BlueBird does not warrant that the content of this tool is current, complete, or accurate.

10. Governing Law

These Terms of Use and your use of this tool are governed by the laws of the Province of Ontario and the laws of Canada applicable therein. Any disputes arising from the use of this tool shall be resolved in the courts of Ontario.
